AIR AMBULANCE CRASH

Medical helicopters have become an integral part of medical response teams throughout the United States and the whole world. Every major medical center has one or more air ambulance helicopters on standby 24 hours a day. While most air ambulances are used on major emergency automobile / traffic accidents, many are used in air and sea rescues, mountainous search and rescues and rural transfers of the critically injured to regional hospitals.

In most cases the air ambulance helicopter is operated by a Local or Regional Medical Center. Most air ambulance services are set up as a legal partnership between a Medical Center and a Helicopter Service. The hospital owns the helicopter and supplies the medical personnel, while the medical helicopter service company supplies the pilots and maintains the helicopter. This arrangement is preferred for safety reasons as it the checks and balances under closer scrutiny.

Under this preferred setup, the air ambulance helicopter pilot is employed by a different entity than the air ambulance nurses and medical attendants. If in a crash scenario, the paramedic and / or flight nurse are injured or killed while working on air ambulance, they can bring an action directly against the owner / operator or the helicopter, pilot and other negligent entities. If however, the pilot of the air ambulance and the paramedic and flight nurse are employed by the same employer, then a workers compensation claim and other legal actions directly against the employer, the helicopter manufacturer, rebuilder, air traffic controller, dispatcher and others must be fully explored on behalf of the injured party.

Helicopter Crash Lawsuits can be as complex as the helicopter itself.

Flight nurse Stein Rosqvist suffered severe injuries. The three, flying as Life Flight 6, had lifted off from LDS Hospital in Salt Lake City to pick up a critically injured victim of a truck rollover on Interstate 80 near the Nevada state line. When Life Flight 6 reached the airport, the pilot asked the tower for permission to cross the flight path "to see if it clears up any better for us."
According to the NTSB accident report, Bingham proceeded west, but at 8:41, on the west side of the airport, he asked to return east because of deteriorating visibility. The tower told him to hold his position until he could see approaching aircraft or a hole opened in the fog. At 8:44 p.m., the pilot called his dispatcher complaining of the fog. "AirMed got sent out for this same damn thing and then they called us to go out. AirMed turned around for low visibility, so they go shopping for another helicopter and we're turning around at the west side [of the] airport. . . ." The air ambulance pilot was unable to obtain clearance and was forced to hold, when the emergency mayday call was declared for the medical helicopter. (Case Currently Pending)
